Father to get insurance payout after killing son in road accident in China: report

A court has ruled that a man who ran over and killed his son in eastern China is entitled to claim an insurance payout for the car accident, according to a news website report.

The man hit his wife and son unintentionally after they got out of the family’s car in Cangnan county in Zhejiang province last December, Thepaper.cn reported.

His wife survived, but the couple’s insurance company said they could not claim on their policy as their son was a family member and exempted from any payouts, the article said.

The couple, who were not named in the report, took legal action and a court in Wenzhou has ruled in their favour.

They could get a payout of 560,000 yuan (HK$645,000). The report did not state the age of the couple’s son.

The company showed a contract it claimed the wife had signed, with a provision saying that if anything happened to one of the family members of the insurer then it was not liable. The wife denied the signature was hers, the report said.

The court ruled the provision violated China’s insurance legislation and went against the spirit of the law, which was about upholding justice.
